1. Acceptance of Terms By downloading or using Pulse, you agree to be bound by these terms of use ("Terms"). If you do not accept the terms contained here, you should not use Pulse. 2. Streaming Platform Accounts a. Connecting to External Accounts: You may link your accounts from music streaming services such as Spotify, Apple Music, and Deezer to Pulse. You must adhere to the terms of use of these respective platforms when using their services through our Application. b. Access and Security: You are responsible for maintaining the confidentiality of your account credentials and you agree not to share this information with third parties. Pulse does not store the passwords of third-party platforms. 3. Use of the Application a. Limited License: We grant you a revocable, non-exclusive, non-transferable license to download and use Pulse on your devices in accordance with these Terms. b. Restrictions: You must not use Pulse to: Send or transmit illegal, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable material. Spread viruses or any other malicious code that could compromise the functionality or security of the Application. Extract, collect, or store personal data about other users without their explicit consent. 4. User Content a. Rights to Content: You retain all your rights to the content you create, upload, post, or share through Pulse, but you grant Pulse a worldwide, royalty-free, perpetual license to use, reproduce, distribute, modify, adapt, create derivative works from, publicly perform, and display your content in the operation and promotion of the Application. The content of the music (covers, excerpts) is subject to copyright and belongs in fact to the artist who produced it or to the record label. b. Content Responsibility: You are solely responsible for the content you submit through Pulse and for the consequences of its publication or sharing. 5. Modifications to the Terms We reserve the right to modify these Terms at any time. You are encouraged to regularly review these Terms. Your continued use of Pulse after such modifications constitutes your acceptance of the new Terms. 6. Termination We may terminate or suspend your access to Pulse without notice or liability for any reason, including but not limited to, your breach of these Terms. 7. Disclaimer and Limitation of Liability Pulse is provided "as is" and "as available". We do not guarantee that Pulse will be error-free or uninterrupted. Under no circumstances will we be liable for any indirect, special, incidental, or consequential damages arising from the use of Pulse. 8. Governing Law and Jurisdiction These Terms shall be governed and construed in accordance with the laws of the country where the headquarters of the publisher of Pulse is located, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of that country. 9.
